Terms of Service

Please read these Terms of Service carefully before booking a session with Lisa Poseley Photography. By booking a session and submitting a retainer, you agree to the following terms.
1. Booking & Retainer
A non-refundable retainer fee is required at the time of booking to secure your session date. Your date is not held until the retainer has been received and your contract has been signed. The retainer is applied toward your total session balance.
Retainers are non-refundable under all circumstances. However, retainer credit may be applied toward a rebooked session under the following terms:
1st rebook: Full retainer value applied
2nd rebook: 50% of retainer value applied
3rd rebook: Retainer forfeited; no credit applied
Rebook credit is available only when proper notice is given per Section 3. Lisa Poseley Photography reserves the right to make exceptions to this policy at her sole discretion when circumstances warrant.
2. Payment
The remaining session balance is due prior to or on the day of your session unless a payment plan has been arranged in advance. For print and product orders, payment is due in full before orders are placed with the lab. Lisa Poseley Photography accepts major credit cards, debit cards, and electronic payment.
All sales are final. No refunds will be issued once a session has taken place or once a product order has been submitted to the lab.
3. Cancellation & Rescheduling
Rescheduling: Sessions may be rescheduled with a minimum of 7 days' notice, subject to availability. Rescheduling requests made with less than 7 days' notice may result in forfeiture of retainer credit per the schedule in Section 1.
Cancellation: If you choose to cancel your session entirely, your retainer is non-refundable and no rebook credit will be applied.
No-shows: If you do not appear for your scheduled session without prior notice, your retainer is forfeited in full and no rebook credit will be offered. No exceptions.
If Lisa Poseley Photography must cancel due to illness, emergency, or circumstances beyond her control, you will receive a full refund of all payments made or the option to reschedule with your full retainer credit preserved.
4. Newborn Sessions
Newborn sessions are scheduled around your due date. We understand that birth timing is unpredictable and will do our best to accommodate date changes. Please notify us within 48 hours of your baby's arrival so we can adjust your session date accordingly. Newborn sessions are ideally photographed within the first 5–14 days of life, so prompt communication helps ensure the best results.
5. Lateness
Sessions begin and end at the scheduled time regardless of late arrival. Lisa Poseley Photography will accommodate within the remaining session time where possible but is not obligated to extend the session or reschedule due to client lateness.
6. Mini Sessions
Mini sessions are offered at a reduced rate and are strictly limited to the purchased time. Mini sessions are non-refundable and non-transferable. Rescheduling is available with 7 days' notice, subject to availability, and is subject to the rebook credit schedule in Section 1.
7. Weather
Sessions will proceed as scheduled whenever conditions safely allow. The decision to reschedule due to weather is made at the sole discretion of Lisa Poseley Photography. Clients will be notified as early as possible if a weather reschedule is necessary. Weather-related rescheduling initiated by Lisa Poseley Photography will not count against your rebook credit. Weather-related rescheduling requested by the client is subject to the standard rebook policy in Section 1.
8. Image Delivery
Edited images will be delivered digitally via an online gallery within the timeframe communicated at the time of booking. Typical delivery times are:
Portrait & Family Sessions: 2–3 weeks
Newborn Sessions: 3–4 weeks
Mini Sessions: 2–3 weeks
Rush editing may be available for an additional fee. Gallery access links will be sent to the email address on file. Lisa Poseley Photography is not responsible for expired gallery links if the client does not download images within the access window provided.
9. Print & Product Orders
Print and product orders are placed through Lisa Poseley Photography's professional lab partners. All sales are final once an order has been submitted to the lab. Lisa Poseley Photography is not responsible for damage to prints or products after delivery. In the event of a lab error, reprints will be arranged at no additional cost to the client.
10. Copyright & Usage
Lisa Poseley Photography retains full copyright of all images created during your session. Clients are granted a personal use license to print, share, and display their images for non-commercial purposes. Images may not be sold, used for commercial purposes, altered, or submitted to third-party publications without prior written consent from Lisa Poseley Photography.
Lisa Poseley Photography reserves the right to use session images for portfolio, website, blog, email marketing, and promotional purposes.
11. Model Release & Social Media
By booking a session, you grant Lisa Poseley Photography permission to use images from your session for promotional purposes including website, blog, email marketing, and printed materials.
Social media opt-out: Clients may request that their images not be shared on Lisa Poseley Photography's social media channels. To opt out of social media sharing, please submit a written request prior to your session date. Please note that opting out of social media sharing does not affect use of your images for website, portfolio, blog, or email marketing purposes, which remain permitted unless separately requested in writing.
12. Liability
Lisa Poseley Photography will take every precaution to ensure the safety and comfort of all clients, particularly during newborn sessions. However, Lisa Poseley Photography is not liable for any accidents, injuries, or property damage that may occur during a session.
In the unlikely event that images are lost due to equipment failure, theft, or circumstances beyond our control, liability is limited to a full refund of all payments received. Lisa Poseley Photography maintains backup systems and professional-grade equipment to minimize this risk.
13. Governing Law
These Terms of Service are governed by the laws of the State of Minnesota. Any disputes arising from these terms shall be resolved in Hennepin County, Minnesota.
14. Agreement
By submitting a booking retainer and signing your session contract, you confirm that you have read, understood, and agreed to these Terms of Service.
